A.  Distribution of Property to Beneficiaries or Heirs

  1. If the real property is separate property:

If Testate: Personal Representative's Deed (SP - Testate) form.

If Intestate: Personal Representative's Deed (SP - Intestate) form.

  1. If the real property is community property and is being distributed to Decedent's surviving spouse:

If Testate: Personal Representative's Deed (CP - Testate) form.

If Intestate: Personal Representative's Deed (CP - Intestate) form.

  1. If the real property is a beneficial interest in a Deed of Trust:

Personal Representative's Assignment of Deed of Trust form.
  1. If the real property is land that Decedent sold subject to a Real Estate ("Land") Contract:

Personal Representative's Deed & Assignment of Real Estate Contract form.

  1. Personal Property

Personal Representative's Assignment of Personal Property form.
